Former Bandera Central Appraisal District employees Melissa Checkovage, Jana Herrera and Nelia McNeal have filed suit against the district claiming violations of the Texas Whistleblowers Act and wrongful termination.
The case was filed March 18 in the 198th Judicial District/Bandera County by Attorneys Stephan B. Rogers and Ross S. Elliott of Rogers & Moore, PLLC in Boerne, and Attorney Brian Moffatt of Moffatt Law Group in Boerne. In the filings, Checkovage, McNeal and Herrera claim their constitutional rights were violated under the First, Fifth and Fourteenth Amendments.
BanCAD Attorneys Charles S. Frigerio and Hector X. Saenz, of the Law Offices of Charles S. Frigerio in San Antonio, filed their response April 29. They deny the allegations and assert governmental immunity under the Texas Tort Claims Act.
Both sides have requested a jury trial.
